Agreement to Terms
These Terms of Service constitute a legally binding agreement between you and NGSMedia LLC, a Wyoming limited liability company ("OurKinks," "we," "us," or "our"), located at 312 W 2nd ST 4192, Casper, Wyoming 82601. These terms govern your access to and use of our platform, including all content, features, and services available through ourkinks.com (the "Platform").
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Platform.
Important: These Terms include an arbitration agreement and class action waiver that affect your legal rights. Please review Sections 18-19 carefully.
1. Eligibility Requirements
The Platform is exclusively available to individuals who meet all of the following criteria:

- •You have reached the age of majority in your jurisdiction
- •You possess the legal capacity to enter into binding agreements
- •You are not legally prohibited from accessing adult-oriented content
By using the Platform, you represent and warrant that you satisfy all eligibility requirements. We reserve the right to request verification of your age at any time.
2. Definitions
The AI creator platform powered by artificial intelligence technology, including chat functionality, content generation, and related features.
A recurring paid membership granting access to premium features for a specified billing period.
Virtual currency purchased through the Platform for use with specific features and content generation.
Any input you provide to the Service ("Input") and any output generated by the Service ("Output"), including text, images, and other media.
Any individual who accesses or uses the Platform, whether as a guest or registered account holder.
3. Platform Description
OurKinks is an AI-powered platform providing interactive experiences with artificial intelligence creators. Our AI technology generates conversational responses and visual content designed for adult entertainment purposes.
Understanding AI-Generated Content:
- •All interactions occur with AI systems—no human operators are involved in conversations
- •AI-generated content is entirely fictional and does not represent real individuals
- •Our AI technology continuously evolves, and output quality may vary
- •Content is provided for entertainment only and should not be considered professional advice
4. Adult Content Acknowledgment
The Platform contains AI-generated content of an adult nature, including but not limited to graphic depictions and descriptions of nudity and sexual activity. By accessing the Platform, you confirm that:
- •You are legally permitted to view adult content in your jurisdiction
- •You choose to view such content voluntarily
- •Accessing this content does not violate any applicable laws or agreements you are bound by
Zero Tolerance for CSAM
OurKinks maintains an absolute zero-tolerance policy regarding child sexual abuse material (CSAM). We prohibit any content depicting, suggesting, or involving minors in sexual contexts. If you encounter any such content, report it immediately to support@ourkinks.com. We cooperate fully with law enforcement agencies investigating child exploitation.
18 U.S.C. § 2257 Exemption
All visual content on OurKinks is generated entirely by artificial intelligence. No actual human beings are depicted. Pursuant to 28 C.F.R. § 75.7, OurKinks is exempt from the record-keeping requirements of 18 U.S.C. § 2257 as we are not a producer of visual content depicting actual human beings.
Anti-Human Trafficking Policy
OurKinks is committed to combating human trafficking in all its forms. We maintain a strict zero-tolerance policy against any content or activity that promotes, facilitates, or is connected to human trafficking, sexual exploitation, or forced labor.
Our Commitment:
- • We prohibit any content depicting real human trafficking victims or scenarios
- • We do not permit advertising or promotion of commercial sexual services
- • We cooperate fully with law enforcement investigating trafficking-related crimes
- • We train our team to recognize and report signs of human trafficking
- • All content on our platform is AI-generated and does not involve real persons
Reporting: If you suspect any activity related to human trafficking, please report it immediately to support@ourkinks.com and contact the National Human Trafficking Hotline at 1-888-373-7888 or text "HELP" to 233733.
We are dedicated to maintaining a safe platform and will take immediate action against any violations of this policy, including account termination and cooperation with authorities.
5. Account Registration & Security
To access certain features, you must create an account. You agree to:
- •Provide accurate and complete registration information
- •Maintain the security of your login credentials
- •Notify us immediately of any unauthorized account access
- •Accept responsibility for all activities conducted through your account
Your account is personal and non-transferable. We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.
6. Communications
By creating an account, you consent to receive electronic communications from us, including:
- •Account notifications and security alerts
- •Transaction confirmations and billing information
- •Service updates and announcements
- •Marketing communications (with opt-out available)
You acknowledge that communications may contain adult content. You can manage your communication preferences in your account settings or by contacting support.
7. Intellectual Property Rights
The Platform, including all AI technology, software, designs, text, graphics, and other content, is owned by NGSMedia LLC and protected by intellectual property laws.
Your License
We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.
Content Ownership
You retain ownership of your Input. To the extent permitted by law, OurKinks owns all Output generated by the Service. You grant us a license to use your Input for providing and improving our services.
8. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
Illegal Activity
Using the Platform for any unlawful purpose or to violate any laws or regulations
Minor Exploitation
Creating, requesting, or sharing any content involving minors
Harmful Content
Generating content promoting violence, self-harm, harassment, or discrimination
System Abuse
Attempting to hack, scrape, or interfere with Platform operations
Impersonation
Falsely representing your identity or affiliation with any person or entity
Commercial Use
Using the Platform or Output for unauthorized commercial purposes
9. Content Standards
All Input must comply with these standards. Content must not:
- •Contain or request CSAM or any content involving minors
- •Depict non-consensual sexual acts or violence
- •Promote hatred, discrimination, or extremist ideologies
- •Infringe on intellectual property rights
- •Contain malware, spam, or fraudulent content
- •Violate privacy rights or share personal information without consent
We actively monitor content and reserve the right to remove any material violating these standards and to terminate accounts of repeat offenders.
10. Subscriptions & Payments
Billing
Subscriptions are billed in advance on a recurring basis according to your selected plan (monthly, quarterly, or annually). You authorize us to charge your payment method automatically until you cancel.
Credit Purchases
Credits are charged at the time of purchase. All credit purchases are final and non-refundable except where required by law.
Cancellation
You may cancel your subscription at any time through your account settings or by contacting support@ourkinks.com. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial periods.
Price Changes
We may modify pricing with at least 30 days' notice. Price changes take effect on your next renewal date, allowing you to cancel if you disagree with the change.
11. Refund Policy
Due to the digital nature of our services:
- •Subscription fees are generally non-refundable
- •Credit purchases are final and non-refundable
- •Billing disputes must be reported within 30 days
If you believe you were charged in error, contact us at support@ourkinks.com with details of the disputed charge. We will investigate and correct any verified errors.
12. Disclaimers
THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
AI-GENERATED OUTPUT MAY BE INACCURATE, INCOMPLETE, OR OFFENSIVE. YOU ACKNOWLEDGE THAT OUTPUT IS FOR ENTERTAINMENT PURPOSES ONLY AND SHOULD NOT BE RELIED UPON FOR FACTUAL INFORMATION OR PROFESSIONAL ADVICE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NGSMEDIA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless NGSMedia LLC and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- •Your use of the Platform or Service
- •Your violation of these Terms
- •Your Input or any resulting Output
- •Your violation of any third-party rights
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
16. Dispute Resolution & Arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
Binding Arbitration
Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration administered by an established arbitration provider in Casper, Wyoming, under its applicable rules.
Class Action Waiver
You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative proceedings.
Jury Trial Waiver
Both parties waive any right to a jury trial for disputes subject to arbitration.
Small Claims Exception
You may elect to pursue claims in small claims court instead of arbitration if your claim qualifies and you provide written notice within 60 days of the dispute arising.
17. Time Limit for Claims
Any claim arising from these Terms or your use of the Platform must be filed within one (1) year after the claim arose, or such claim shall be permanently barred.
18. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
Changes to dispute resolution provisions will not apply to disputes arising before the change was posted.
19. Severability & Entire Agreement
If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force.
These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and NGSMedia LLC regarding the Platform.
